REQUIREMENTS

Detached accessory structures

  • must be located at least ten (10) feet from any side or rear lot line
  • must be 6’ from any other structure
  • are permitted only in the rear yard
  • shall not exceed fifteen (15) feet in height
  • The total square footage of all accessory structures shall not exceed fifty percent (50%) of the square footage of the footprint of the primary structure.

Each Property

  • shall have no more than two (2) accessory structures located on the property or utilize more than twenty-five percent (25%) of any available land outside of the required setbacks for accessory structures
  • The total square footage of all accessory structures on the property shall not exceed fifty percent (50%) of the footprint of the primary structure
  •  Any accessory structure constructed of metal, plastic, or fabric shall not exceed 150 square feet in total floor area except within an Agriculture District, provided that such structure is accessory to a principally or conditionally permitted use (other than a single-family dwelling) within said district

When is an accessory structure zoning permit required?

Prior to constructing, erecting, adding to, or moving any detached structure (e.g., shed, gazebo, playhouse) in a residential zoning area.

What do I have to do to receive a permit?
♦ Complete the Accessory Structure Zoning Permit application and submit to the Zoning Administration Office. The permit must show location information including all existing and proposed accessory structures and their square footage.

♦ The information on the application should be in compliance with the requirements of Chapter 1189.01 (Supplemental Regulations; Accessory Structures) of the Zoning Code.

 The information on the application should be in compliance with the requirements of the applicable zoning district for your property.  District information is found in Chapters 1140 through 1155, 1171, 1173.  For more information click here.

Fences placed within a utility easement may be subject to damage or removal at the owner’s expense if necessitated by utility company access. Additionally, by signing this application, the applicant, the owner, or agent of the owner, is exempt in the City of any liability for illegal or inappropriate placement of the appropriate fence.

When is a fence permit required?
Prior to erecting or replacing a fence, or planting a hedge row that would function as a fence.

What do I have to do to receive a permit?
♦ Complete a Fence Permit application and submit to the Zoning Administrator’s Office. The Fence Permit application must show the location of all proposed and existing fences, retaining walls and hedges which act as dividers.

♦ The information on the application shall be in compliance with the requirements of Chapter 1189.04 of the Zoning Code.

Fence Requirements
♦ Please see attached Section 1189.04, Fences, Walls and Hedges, of the Trotwood Zoning Code for fence requirements.
♦ Electric and barbed wire fences are prohibited in Residential Districts.
♦ Chain link, wire and steel mesh fences are not allowed in the front yard.
♦ Front yard fences have special requirements.

TROTWOOD ZONING CODE 1189.04 FENCES, WALLS AND HEDGES.

Fences, walls and hedges shall be regulated as follows:
(a) Decorative front yard fences and walls shall be regulated as follows:
(1) Decorative front yard fences and walls may be permitted provided that they do not create an
enclosure, a barrier for access or a divider between properties.
(2) Decorative front yard fences shall not exceed three (3) feet in height within the required front yard. Decorative front yard walls, when built of solid masonry or stone materials, shall not exceed two (2) feet in height within the required front yard.
(3) The length of a decorative front yard fence or wall shall not exceed fifty percent (50%) of the property frontage as measured at the public right-of- way. For the purposes of this Code, corner lots shall be considered as having two frontages.
(4) Support posts for decorative fences and walls shall not exceed forty-two (42) inches in height when used in conjunction with minimum spans of six feet. Masonry and stone posts not exceeding two (2) feet on any side may be permitted.
(5) A minimum of fifty percent (50%) visibility must be maintained through the decorative fence.
(6) In no case, shall chain link, wire or steel mesh be permitted in the front yard.
(b) Other fences, walls and hedges shall be regulated as follows:
(1) No fence, walls, hedges or plantings, when used as a divider, permitted to exceed three (3) feet in height within a required front yard.
(2) No fences, walls, hedges or planting shall be permitted to interfere with visibility to or from a driveway.
(3) All fences, walls and hedges adjacent to any public sidewalk shall be set back at least three feet from such sidewalk.
(4) Within a side or rear yard, no fence or wall structure shall be permitted to exceed six (6) feet in height from its base to its top.
(5) The use of barbed wire for fencing purposes shall only be permitted in the industrial and agricultural districts.
(6) Prior to the erection, construction or placement of a fence or wall, all property owners shall either have their respective lots surveyed or sign a waiver which exempts the City from liability for illegal or improper placement which has resulted from the submission of incorrect or misleading information.
(7) No fence shall be erected, constructed or placed so as to interfere with the provision of adequate light and air.
(8) No fill or earthen berm, which results in a change of existing grade in developed or built-up areas of the City, shall be used to accommodate the placement of a fence or wall.
(9) No fence shall be constructed so as to alter the natural drainage of an existing property.
(10) A fence permit shall be required to be obtained from the Zoning Administrator for the erection, construction or placement of all proposed fences, walls and front yard hedges.
(11) Fences used in conjunction with tennis courts and back stops for ball fields shall be exempt from the height limitations; however, in no case, shall a tennis court or back stop be more than twelve (12) feet in height.
(12) All fences shall be installed so that support posts and other support mechanisms face the inside part of the fence.

REQUIREMENTS

AS REGULATED IN TROTWOOD CITY ORDINANCE 1189.04

Solar panels shall be allowed in all zoning districts either attached to a permitted principal use or accessory building or as an accessory structure subject to the following regulations:

(1)    Freestanding solar panels are prohibited in the front yard.

(2)    Panels that are freestanding or attached shall satisfy the rear and side yard setback requirements of the zoning district in which they are located.

(3)    Solar panels are permitted on the roof of the principal structure or accessory structure, provided that the addition of the panels does not cause the structure to exceed the height requirement for the zoning district in which it is located.

(4)    Solar panels shall be placed and arranged such that reflected solar radiation or glare shall not be directed onto adjacent buildings, properties or roadways.

(5)    Panel systems are subject to the Property Maintenance Code and shall be removed within six months of being nonfunctional.

(6)    No panel shall be used for advertising of any kind.

(7)    A permit is required.

REQUIREMENTS

The requirements of Section 1189.08 of the Zoning Code apply to any manmade pool, pond, lake or open tank capable of containing water to a depth of more than one and one-half (1.5) feet. Such pool shall be setback at least fifteen (15) feet from all side and rear lot lines. Pools shall be surrounded on all sided by a five (5) foot high fence with a locking gate.

When is a swimming pool permit required?
Prior to installing any in-ground swimming pool having a depth of more than eighteen (18) inches below the level of the surrounding and or ay above surface pool of more than thirty (30) inches in depth.

♦ Complete a Swimming Pool Permit application and submit to the Zoning Administration’s Office. The permit application must show the location of the proposed pool and its distance from other structures. 

♦ The information on the application should be in compliance with the requirements of Section 1189.08 of the Zoning Code.

Additional Permits?
♦ A building Permit from Montgomery County Building Regulations is required prior to beginning of construction of an in-ground swimming pool. The application for Building Permit may be submitted at the same time as the application for Swimming Pool Permit and may be reviewed at the same time.

♦ A Fence Permit is required if the proposed swimming pool is not contained within a fence which meets the requirements of Section 1189.8 of the Zoning Code. 

♦ A separate deck permit is required if constructing a deck around the pool.

When is a tent permit required?

  • Prior to erecting a tent in any zoning district in the City of Trotwood.
  • You must obtain a permit for each tent. If you will use multiple tents, you must submit one permit + fee PER TENT.

What do I have to do to receive a permit?

  • Complete a Tent and Festival Permit application and submit to the Zoning Administrator’s Office along with a drawing showing the location of the proposed activity or use on the property.
  • The information on the application should be in compliance with the requirements of Section 1189.09 (f) of the Zoning Code.
