I/ we understand that the operation of this cannabis establishment is responsible for collecting transfer and user taxes pursuant to Chapter 449 of the Code of the Township of Hamilton, New Jersey shall be remitted to the Township' s Chief Financial Officer ( CFO) on the first day of each month and shall be personally liable. Failure to remit any transfer tax or user tax upon the due date established, the unpaid balance, and any interest accruing thereon, shall be a lien on the parcel of real property comprising the cannabis establishment premise. The lien shall be superior and paramount to the interest in the parcel of any owner, lessee, tenant, mortgagee, or other person, except the lien of municipal taxes, and shall be on a parity with and deemed equal to the municipal lien on the parcel for unpaid property taxes due and owing in the same year. A statement showing the amount and due date of the unpaid balance of cannabis taxes. The lien shall be enforced as a municipal lien in the same manner as all other municipal liens are enforced. Any delinquency for any transfer or user tax will be cause for non- renewal of licensee' s permit.
I/ we understand that if the transfer tax or user tax is not paid when due, the unpaid balance, and any interest accruing thereon, shall be a lien on the parcel of real property comprising the cannabis establishment' s premises. The lien shall be superior and paramount to the interest in
the parcel of any owner, lessee, tenant, mortgagee, or other person, except the lien of municipal taxes, and shall be a parity with and deemed equal to the municipal lien on the parcel for unpaid property taxes due and owing in the same year. The lien shall be enforced in the same manner as all other municipal liens and the annual Township permit issued pursuant to Chapter 153 shall not be renewed for the cannabis establishment should any transfer or user tax pursuant to Chapter 449 be delinquent.
I/ we understand that pursuant to N. J. S.A. 40: 52- 1. 2, as a condition of issuance or renewal of a license, all delinquent property taxes or assessments on the property that is the subject of the license or on which a licensed activity or business is or will be conducted must be paid. The license shall be revoked or suspended if property taxes are not paid for three consecutive quarters or more. The license shall be restored upon payment of taxes.
